Wel, so far nothing. I got the paperwork and all for the tow guys to take it...Actaully, quite easy....Scary easy.

Yes, he traded in the car that I loaned him for,and got this new Altima. He was making payment to me and Nissan, now he is unemployed and that stopped.

Tow guys told me the car wasnt at his local today, but they are going to check later.... Still in limbo.

Is he current with Nissan? I'd be more than a little worried that in spite of your having loan paperwork indicating monies owed to you, there is no connection to you and this car.

It's gonna be a mess to clear up and you may end up in possession of a car that you can do little with legalyl until you get a judgement against the guy and even then, the court may or may not award the vehicle to you in settlement of the note.

I really hope nothing bad happens to you Chris.

Chris, heres my two cents. You clearly lent him the money for a car. The contract you drew up was for that vehicle or money you lent him. He purchased the vehicle and (im assuming) you were not on the title. So your buddy decides he wants a newer vehicle and trades in the old one that you lent him money for. Okay, now he has two separate legal contracts one with you and one with nissan. I'm not sure if you have any legal recourse to the nissan. I spent over ten years in the repo industry in So. Cal and if you called me for a repo order, id have to decline you because you are not the legal owner, Nissan is. If you take the nissan from your buddy you may be opening a big ass can of worms. If he is that delinquent with you then id pursue your legal options and take him to court, but leave the nissan alone. If (and I mean if) for any reason your name is on the title for Nissan, and Nissan repo's you may be liable for back payments, repo, and storage. And if for any reason you could not pay those fees, nissan may be able to pursue you for a defficiency balance.

I do not think ( based on your story ) that you have any legal right at all, over the Nissan.

Nissan has all the rights on that vehicle.

When you've lend him the $$$, where you listed as LIEN HOLDER on the traded car?

A - if no, all you have is a promissory note from him.
B - if yes, how did he traded the old car with a lien? did you release that lien?

Just don't get caught up in the moment, if your name it is not associated with the car legally and you TAKE IT ( badly called repo as you are not entitled ) , all you are doing is STEALING THE CAR.

What did your Lawyer say? if he said TAKE IT, my recommendation is get another Lawyer :D

sounds like the best recourse is to take him to civil court and get a judgement against him for breach of contract. Of course, if he is broke, then you are SOL. However, by what you described, DO NOT TAKE THE CAR, if you are not listed as a lienholder, if he wants to get pissy, you could go to jail for theft. You are going to have to decide if he owes you enough money to take him to court for, or just write it off as a bad deal. You need to have a serious face to face with him and hope he mans up.

Heres the latest..


Lawyer put a lein on his title. No biggie. So, that gave me the legal ok to repo the car. The tow truck guys charge $100 to get it, but they kept going past his house and no Altima. Turns out, Saturday night, he punched out of Missouri for Florida. I dont know the laws there, but the Title does have a lein, so that helps.

What a bag of fuck!
