I'm very pissed right now. My wife was almost killed by a drunk driver tonight. A red-light-runner took out the rear end of our Range Rover. Had my wife been a second later she would have been T-boned at 55 MPH in the driver side door. I'm glad she is doing okay though she is just bruised up pretty good. The guy blew .22 at the accident scene.

i hate them too, i had one rear end me and of course the idiot had no insurance.
glad to see she's doing ok.

My wife was on a ski vacation and I wasn't there had I been there I would have lost my patience and try to hurt the guy. I'm sure the insurance company will take pictures of the truck at the junkyard sometime next week. But that's the least of my worries right now

Yeah, I was just curious to see how bad of a wreck it was. Is your wife home now or still stuck out of town??

Hope your wife is okay. People who drink and drive should get a mandatory 1 year jail time minimum and a stiff fine.

my wife is flying home tommorow morning. The truck has a totaled rear end. I hope this guy fuckin rots in hell

Wow 55 mph is a huge impact, even in a Rover. She is very lucky. I hope it works out O.K. for you both. Keep us posted as to how the legal system handles this.

Damn, I hope he gets some jail time, but knowing our legal system he probablly won't. It's all a bunch of bullshit.

Back in 1989 I had just moved to rural Litchfield County, CT when on the way home from my office in NYC I was hit head on in my 1988 Nissan Pathfinder by a drunk on a Harley FLH full dress. We both were traveling around a bend at 45mph but he failed to straighten out and came across the double yellow.

We have no helmet law in CT. His head shattered my wndshield. His left leg was severed. His blood alcohol level was .262. He had no license, insurance or experience driving a motorcycle let along something as big as an FLH. It took five years of litigatory hell before the civil case (yes, he sued me) was satisfactorily resolved. As far as the criminal aspect, he took an AR and we never could mention the DWI in any of our court filings.

If that experience wasn't enough, in April of 1994 on a beautiful Sunday night at 9 pm, less than 1/2 mile from my previous accident, coming from the opposite a rider on a '78 Harley Low Rider crossed the double yellow and crashed into my brand new Range Rover LWB. His blood alcohol level was .300! He too lost his left leg at the scene. He severely cut into his femural artery and had the accident not occured in front of a house owned by an EMT he surely would have died.

Thankfully, in both instances, I was alone and physically unharmed but the events definitely left a permanent impression.

Prescott, I am happy that your wife escaped physical injury. Love her and comfort her. Events like this force us to reckon with how precious life really is.

AR is Accelerated Rehabilitation. If a defendent pleads to a lesser fine he can opt for AR which usually consists of enrolling in some sort of rehabilitation/education program and a fine. Once AR is completed all records regarding the DWI charge are sealed. A defendent only gets one opportunity for AR and once you burn it you better be good!

PS Both accidents were less than 1/2 mile apart and within 2 miles of my home. The first guy was on his way to a bar and the second was on his way home from one! The joke in New Milford is 'lots of bars and LOTS of windy roads.'

My wife decided to go back to AZ and have her mom move in to our house for the time being. Turns out the guy had a previous DUI so I hope he gets hammered by the legal system.

Hell yeah, a previous DUI will really help out. I hope he gets hammered by the system and them by some guy named bubba if you know what I mean.

Didn't some guy just go to jail here in Portland for being arrested for his 30 something-th DUI? And of course, no insurance, didn't even own the car he was driving.

Damn Prescottj, that's terrible news. Glad your wife is OK, though.

Those are some messed up stories about the Harleys too. How can you blow a .26 or a 0.3 and still sit on a bike, much less ride it? And then sue??? That's not right.

j...sorry to here about your wife and the rover. what a bastard!! these people will never learn until the kill someone..even then. I had two girlfriend killed in highschool by a drunk ass!! good thing your wife was in the range rover and not some tin can of a car. take care of her. im sure she is frazzled by it

Glad your wife's alright, that is really all that matters no matter what. Drunk driving....I can't say alot, I've done it before. I was young and ignorant, and very fortunate not to have killed anyone or myself. I have a friend who is an alcoholic and spends the majority of his life intoxicated. He's had 3 DUI's that I know of, and violated probation/etc. a number of times. I'm thinking he got house arrest after his 2nd though. His 3rd put him in jail for a year and no license for a couple of years. I hang out with him occasionally now, and he is no longer DUI, he calls a cab or a friend if he's had more than a couple of beers. Anyhow, good to hear that she's ok.. Later.. Rob

I'm so happy to hear she is ok, though I know what she will have in store for her in the form of rehab/physical therapy. Did it spin the car? I was recently rear-ended by a pick-up truck at 55mph and it freaked me out. Paramedics said if I had been in my rover (was in a 2002 Grand Am rental) I would have been in better shape.

I hope that she recovers soon and that you get your Rover back to feel safe!

My sister was hit by a drunk driver but he was never charged. They didn't do a breathalizer and the guy's insurance took 5 years to pay. He was going about 60mph and she was going 30; hit her left front corner head on. Luckily she was in a BMW 3-series that saved her life. That little car took the entire impact, and she only had a cut knee and some seatbelt bruises. I wanted him dead when I heard her on the phone line crying.

I think she will be okay becuase she is really mentally tuff. She did seemed really freaked out when I first talked to her on the phone. And then when I saw here this morning at Sea-Tac she did'nt seem to shook up just a little soar. The doctor said she will be fine after a week or so after the soreness goes away.

Too bad the accident wasn't in WA. WA has pretty tough DUI laws (I used to do criminal defense in Seattle). Generally, a WA second offense with a .15+ BAC (unless the laws changed since 2000) will net you 45 days jail; 120 days electronic monitoring (home detention); and two year license suspension -- all if convicted. Plus there are administrative license consequences as well (ie: additional suspensions).

Be forewarned that the experienced DUI driver will be harder to convict (generally) as they perform better on field sobriety tests (increased tolerance), refuse the breath tests (because the license suspension for a refusal is about the same as a second offense conviction suspension), and know enough to shut up. That's the problem with current DUI laws.

Make sure the wife stays local (or maybe in Canada) for skiing in the future.

Boy my memory is going. Actual 2nd offense (w/in 7 yrs.) penalty for a refusal or 0.15+ in WA is (was -- I'm still two years out of date, but I haven't heard of a change): 45 days jail; 90 days electronic monitoring; $750 fine ($1325 with costs/assessments); and a 900 day license suspension. The administrative licensing consequence would be most likely another two year suspension. Just to set the record straight.

very sorry to hear about your wifes close call Prescott J...very scarry

my father ran the outpatient dept at Depaul D&A rehabilitation hospitol in milwaukee for 30 some years and one sad fact he used to quote has always stuck in my head

the average drunk driver drives intoxicated just over 400 times for every DUI they recieve!

we are way to soft on DUI's we should take a lesson from Sweden and Denmark at put people away for 5 to 10 years the first time and put some teeth in the laws.

Paul I can't imagine how you can ride drunk. In college I tried to ride a bicycle drunk once. After the third time in less than 100 yards or so of ending up flat on the ground I gave up.

Hi Tom,
I was told by the Police invesigating the first accident that in order to do anything with even the slightest level of competence as your blood alcohol level rises above .10 indicates that the body is accustomed to such levels. To be able to even balance a heavy motorcycle like and FLH or even a Low Rider speaks to the levels to which both of these guys drank on a regular basis.

The guy in the first incident was so drunk that even after loosing his leg below the knee and sustaining massive head injuries he kept trying to stand up and move around! It was like a psychotic scene out of any of a number of gruesome war movies but it wasn't make believe.

Till the day I die I think I will always cringe as I pass motorcycles on the road.
