So I purchased a Dog Guard for the DII off of a guy on LRX.com. He said it was brand new. When I got it in the mail, it was bent up and one of the bars was broken. I contacted him and he assured me it was new and that UPS probably damaged it. He said that I should make a claim with UPS so I did. UPS picked it up and sent it all the way back to GA to the UPS store he used to send it. Apparently this is the ridiculous way they handle these claims.

After the inspection, UPS refused to take responsibility due to "insufficient packing." So they gave the entire package back to the seller (total BS since I own the contents but that's another issue).

Anyway, now the seller has it and hasn't answered or returned any of my emails or calls in 2 months. Seems totally ridiculous that he's dodging me when he told me to make the claim. All he has to do is answer my calls so we can figure out the situation. At this point I'll just take it in the condition it is...he just has to send it back to me. I'm totally pissed and am about to fly out to GA to kick some ass.

Anyway, wanted to see if anyone has the urge to shake someone up for me and get this dog guard back for me? Any help or suggestions would be appreciated.

Call the credit/debit card company that you used and explain the situation to them. They should be able to assist you in getting your money or merchandise.

Honestly, whenever there is an issue with a damaged item, regardless if it occurred during shipping or not, I will request/receive my refund from seller before item is returned and a claim officially filed.

It's just too risky to be out funds and then product.

With UPS, the sender is supposed to submit the claim. That is probably why they returned the guard back to him. Sadly, my experience with UPS is that they will pretty much deny any claim that comes their way...I bet they have a whole list of "valid" excuses so that they are never at fault. I never send anything back to UPS cause I know it will disappear or be worse if I ever ever get it back.

Hopefully you paid with a credit card. The one time I got dicked on a deal gone bad (company filed bankruptcy after I sent them my dough) I filed a complaint with Visa and Bank of America and it was credited back to my account. I did submit documentation showing the bankruptcy letter. As long as you have records from the seller and UPS showing the damage and lack of response you should be able to get the money back.

Well, I guess I'm totally F'ed because I paid him by check eventhough I was really reluctant to when he requested it. I always like to pay by paypal if I can.

What's weird is, is that I have all the mounting hardware he sent in a separate package. All the hardware is brand new. Not sure what he'd do with a dog guard and no hardware.

I'm going to call and email his ass everyday until he responds. I also have a really good friend from Atlanta who has a lot of friends back there. I may have to call in a favor...

I'll post this guy's info soon.

BTW, I've always hated UPS. They're just about tied with the USPS for crappy service. I find FedEx to be the best shipper. I may start calling UPS and raise some hell until they compensate me for the dog guard.

Good friggin luck, it took me over three months to get repayment for a Stainless Brush bar the Fed Ex ground lost for me. I was the shipper and I had to refund the guys money and wait on my refund. You will find out that the declared value and what they will pay are seldom the same thing. I had to send them invoices and copies of all the documents including the ebay auction and they denied my claim like four times before I finally got reimbursed.

Yeah, that's what I figured...I guess it can't hurt to try. Years ago it was so easy making claims with UPS. Never thought it would be this much trouble now.

Post his name, phone number, address, etc. Two months is about 7.5 weeks too long to go without returning your calls, this guy is a prick and needs to be outted.

I had this happen to a third I sold will tillery..

UPS dropped it so far it bent the flange on the pinion, I gave will his money back, they sent me a letter saying it was insufficiently packaged. SO I called and asked them how its my fault they dropped it so far it bent steel.. no packaging will hold up to that, they told me to get bent and sent it back to me..

Anyways I almost always use FED EX now!

Thanks, all. I'm going to give him about two more days and then I'm posting his info. I just tried calling him 4 times in the last 15 mins and still no answer. His address is in Atlanta 30316. I'm definitely not letting him get away with this scott free.
