Michael called up sounded like (sorry honey) an ignorant kid and Jeff took advantage of him. Plain and simple. Can I say I blame Jeff? Would I have taken advantage of Michael too in order to make an extra $50? Is it really worth that $50??I will scan the copy of the receipt later for the $85 CDL handle and post it here on DWEB. One thing I despise most is blatantly being taken advantage of. Reminds me of the sob story from Marc (MVM) about his starving kids and ex-wife in regards to my lights for sale. :rolleyes:

My rebuttle: If you do the right thing in life, practice honesty, integrity, and virtue then why would this be an issue? Sure maybe Jeff made a mistake? Maybe he presumed that the price he charged was accurate for a piece of metal that was fab'ed wrong. OK so you're human so am I.

I do not know about Jeff, what I do know is that I have a hard time ethically and morally charging people more than what an item is worth; which is why I give half of my stuff away for free on DWEB (from Land Rover Coffee to Tire covers) or offer to ship for free or whatever. OFF BOX!


Wow! I'm not sure where to start. First off, thanx for the referrals. Secondly, you're right about what certainly appears to be a case of being overcharged.

For the record, I didn't mean to defend JC (I've met the man, he seemed nice enough until he nearly ran out of gas on a trail), I was merely making general references to the fact that we are all human and in spite of our best intentions, things sometimes go awry, be it for unreasonable expectations on one part, misrepresentation, or outright dishonesty.

I have always tried to be honest in my dealings yet there are still those who can never be satisfied. Sadly, there are several in my town who will never be satisfied with the work I did on their trucks.

As for giving things away, run up here and bring a truck!;)

Cash is the only form of payment but it tells you to agree not to stop payment on a check or credit card.

Hmm.....

Maybe the DWeb legal advisor can chime in, but isn't that kind of like saying... "You agree not to call the police if I happen to steal your DVD player while I'm cleaning your home"? Can they put a clause in a contract that negates someone's legal right?

I had my uncle read it real fast, and first words out of his mouth: "It won't hold up in court". Stating most Az cities have set-rate laws for impounding and storage, as well as consumer protection acts. He could file a lien on your vehicle title for lack of payment, but as for repo'ing it, he might have a hard time with that one. We both agreed that if we saw that disclaimer on the sheet, we'd call the tow company to to us to another mechanic.

As for being in texas: "In order to enforce a perfected mechanic's and materialman's lien against a private construction project in Texas, a lawsuit must be filed seeking the foreclosure of the lien. A mechanic's lien can only be foreclosed on the judgment of a court of competent jurisdiction (Texas Property Code Sec. 53.154). The judgment entered in such a proceeding shall foreclose the lien and order the sale of the property subject to that lien. In order to determine what court is a court of competent jurisdiction, you must determine what court has jurisdiction and venue of a suit to foreclose a mechanic's and materialman's lien.
