I think he didn't intend to pass, but saw the police car at the last second and took evasive (panic) action and lost control. I had a women come up behind me one night on Rt. 29 at 88 in a 55 and about the time she started to pass in the right lane she must have realized I was in a marked patrol car. She slammed on the brakes and veered to the right directly into the end of the gaurd rail. The front of her car sheered off and I had to slam the brakes and hit the grassy median to avoid hitting her car when it bounced back into the road. She went to jail.

I'm sure he saw the PO and panicked and tried to pass on the left (in the grass) to claim he lost control. His other option would have been to pass on the right (hand lane) pull over instantly and claim he had to piss like a race horse in June.... The second option would not have landed him in the hospital.
