Deja Vu. My Volvo was totalled by someone with crappy insurance. The driver got out of the car and took off running. Turns out he just got out of prison and was drinking with his girlfried. Things went south and he jumped in her car. She jumped in too. Her insurance company could have made a easy claim that she wasn't liable since technically it was stolen, but they weren't that smart. Good luck man.

What about your insurance? Shouldn't they go after them for monies for you? I've never been in your situation so I don't know.. I have had to use uninsured motorist insurance once for a guy who rear ended me then split, but that was 18 years ago.

Claim the Kia's owner for the damages, it is stupid for him to buy insurance that can only cover 25k, which means the insurance pay up to 25k and the owner pay the rest.

I carry 100/300/100 on all my vehicles.. even the RRC which sits in the garage 99.8% of the time, it really doesn't cost that much more in the long run.

Definitely go after them.. or just ram their Kia as I mentioned before:)
