Your wrong and way confused. If the other truck hit his brakes and Eric hit him it is Eric's fault plain and simple. It's called following to close or improper following distance. I can dig out my vehicle code and find the exact statute. Every accident I investigated when I was a cop involving a rear end collision the driver following was at fault.

I had to write alot of tickets that I didn't want to write but like everything else if you don't do it by the letter of the law you leave yourself open to liability from the shitbag lawyers. Which is all of them. Unfortunately there is no gray area anymore when you are a Leo. Unless your looking to get sued and or fired which is why I left the profession.
