Lets say I'm passing through a intersection at 50mph (legally). A guy hangs a right in front of me and JUST gets straitened out so I hit him square in the rear. I'M the one at fault? This is where the lawyer comes in.

Your wrong and way confused. If the other truck hit his brakes and Eric hit him it is Eric's fault plain and simple. It's called following to close or improper following distance. I can dig out my vehicle code and find the exact statute. Every accident I investigated when I was a cop involving a rear end collision the driver following was at fault.

I get it that you have to give him the ticket by the letter of the law, but I'd also bet a judge will give him some lee-way on this one. Unless he's a total hard-ass.

That's the way I understand the law. Once he's in the lane it's his lane. Even if he's in the space you would be in if you didn't brake.

I never figured Eric could get out of finally paying up. Just delay it to be a dick. Eric's fucked.

I completely agree. Cops can't be cops anymore. And we'll all pay in the end.

It is hard to believe a car making a right turn on red has no responsibility as long as they can make it into the lane. That would take a very perverse reading of the "must yield to traffic coming through the intersection" regulation.

If the law wasn't written like that how would you enforce it. When does somebody not say "if he was going the speed limit he could have avoided hitting me" Then also how many ass holes would just start hitting cars cause they felt like they could.

It's not the end of the world someday your gonna get to hit the side of someone's car while it really is your lane

I never understood the "brake-check" thing. I mean, I know what it is. And sure, I've been plenty pissed about some guy on my ass, but why the hell would you WANT someone to hit your vehicle? (except for the insurance fraud assholes).

I bet in their mind the slight chance of being hit is worth forcing someone to emergency brake and panic. This guy was only mildly surprised to have a steel bumper rammed up his tail pipe.

who knows maybe he had a bad day and still thinks like a kid. That goes on into the 30's for some people. I bet he knows now how he let his emotions fuck his shit up. It wasn't Eric honking at him that fucked his shit up, it was his reaction to Eric honking.
