The Hammonds at their sentencing argued that the 5 years was too harsh, and the judge agreed and gave them months (how many judges have given less than manditory minimum sentences for minor drug offenders?). The prosecution appealed and the 9th Circuit Court of Appeals (a very liberal group) agreed and ordered the 5 years.

It's not double jeopardy - the were convicted, but their sentence was changed.

I've read more than one story about how they ended up with longer sentences and do not necessarily disagree with them receiving more than a few months.

They are planning another appeal, they won't be in another 5 years.

You obviously wanted to discuss this and have formed some pretty strong opinions on it.

I think that there are land issues. I think that these are extremist Mormons and that does not help their cause. I think that the locals don't want them there, so even if they have a legitimate concern, it's going to be tough.

I am certainly not going to grab some guns and go help extremist Mormons, that would be a tough choice even if they were correct.

Yeah, rereading that it does seem angry, don't it. Sorry about that.

Could be from my (relatively) short time involved in politics. I got to listen to the Tea Partiers talk about how high taxes were, but if you cut any of their benefits, or services??? Holy cow...

Or to listen to people talk about "freedom" and "public" use, but then want nothing to do with the roles and responsibilities (and that means paying $ for up keep) required for those things.

And as a life-long conservative (with libertarian bent), it really peeves me to see the rule of law ignored. (Especially by the same jokers who want illegals deported. Now.)

Hypocrisy covering up one's personal agenda (free grazing)...:thehand:

I'll step away now...

Their appeals are probably done. The 9th Circuit ruled, their only option is to go to the supreme court, which won't likely change the precedent on mandatory minimums (but who knows?). They have asked Obama for clemency. If no, they're total time will probably be ~4.5 years, less the time they already did.

Yeah, one did 3 months, the other a year. The 5 year sentence was imposed, but they get credit for time served, ie, they serve a total of five years, not 5y 3mo or 6yrs.

The federal system also gives time off for good behavior, but no early parole.

Theyre fuck-ups, nothing more, nothing less. These men aren't patriots or constitutional scholars or defenders. They're petty criminals with little to contribute to the country if anything. They've spent too much time in their "club houses" and basements reading SOF and "Tactical Handgun" magazine and have developed a paranoia for those that don't open carry. They believe their lot in life and general frustration can be attributed to some government conspiracy to take all of our guns or cars, or snack food. All the shit happening in the world and these patriot geniuses are "occupying" a hut on public lands no doubt listening to Racsal Flats and jerking off to the latest issue of"Recoil". Fucking kooks, slip knots, punks, and gapers!

I read recently that Bundy took out a huge gov. loan for a family trucking company. Has not paid us back for that yet. But will go all the way up to Oregon to protest the Government that handed him close to $1 Mil. I admit I know little about whats going on out there. Just not interesting enough for me I guess. I do find it kind of amusing that he seems a little confused by the fact that nobody gives a shit.

I side with the rebels. I don't think Bundy should have been arrested, charged, and jailed for something his family, and other families, have been doing for as long as any of us have been here, including our grandparents and great-grandparents. They played by the rules for as long as they could. It's an overreach of government, just like the Skyline Drive on the 1930's. But the government, just like GM, is too big to fail and they're going to get their way. It should make for a good movie on Netflix, perhaps Joel Salatin can be the host.

It's not Bundy that's going to jail. Those 2 going to jail set a fire to cover up illegal dear hunting and admitted it. I don't care at all as long as somebody pays for the fences they took down. Even the law says they don't care. Not even going to cut the power cause they don't want pipes to freeze. Now those broke back mountain fags are just trying to figure out how to save face and go home without looking like total ass hats. They need jobs or something, who's got time for that shit.

Guess they didn't have a good plan for how to mitigate a vehicle interdiction. Oops.

I like this from the article:

The occupiers also claimed Finicum had his hands in the air when he was shot.

Nevada Assemblywoman Michele Fiore said Ammon Bundy called his wife, Lisa Bundy, from the back of a police car on Tuesday night and said Finicum was cooperating with police when he was shot, according to The Oregonian.

So let me get this straight - there was a gun fight, and Bundy was able to just sit in the back of a squad car and call his wife? Hmmm....OK.:eek:ut:

But nice job by the Feds - they also arrested a few others in OR and in AZ.

And how ironic - Now we'll have white rednecks wearing "Hands up! Don't Shoot" t-shirts.
